Welcome to PartyPilotAI ("the Service"), operated by Jacob ("we," "us," or "our"). By accessing or using our website at https://partypilotai.com or our web application, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

These Terms constitute a legally binding agreement between you and PartyPilotAI.

You must be at least 18 years old and capable of forming a binding contract to use PartyPilotAI. By using the Service, you represent and warrant that:

• You are at least 18 years of age
• You have the legal capacity to enter into these Terms
• You will use the Service in compliance with all applicable laws and regulations

PartyPilotAI is an AI-powered party planning platform that assists users in designing and visualizing party setups for home celebrations. The Service provides:

• **AI Venue Analysis**: Upload photos of your space (backyard, rooftop, living room) and receive automated spatial analysis
• **Party Design Generation**: AI-generated visualizations, floor plans, and decoration layouts based on your input
• **Shopping Lists**: Curated product recommendations with Amazon affiliate links
• **Additional Views**: Multiple perspective renders of your party design

The Service is designed for personal party planning including birthday parties, baby showers, graduation parties, BBQs, and similar home celebrations.

To access most features, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the confidentiality of your login credentials
• Accept full responsibility for all activities under your account
• Immediately notify us of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms or are used for fraudulent purposes.

PartyPilotAI operates on a credit-based system:

**Free Credits**
• New users receive 100 free credits upon registration
• Free credits can generate approximately 3-5 complete party designs

**Credit Costs**
• Main image generation: ~20 credits
• Blueprint generation: ~25 credits
• Additional views: Variable based on quantity
• Total cost per complete design: 20-45 credits

**Purchasing Credits**
• Credits can be purchased in packages starting at $9.99 for 200 credits
• Prices may vary based on package size
• All payments are processed securely through Stripe

**Credit Rules**
• Credits never expire once purchased
• Credits are non-transferable between accounts
• Credits cannot be exchanged for cash or refunds (except as specified in our Refund Policy)
• Upon account termination or ban, all unused credits will be forfeited without refund

**Price Changes**
• We reserve the right to modify credit prices or package offerings
• Changes will not affect credits already purchased
• Advance notice will be provided for pricing changes when possible

**Payment Processing**
All payments are processed securely through Stripe, a third-party payment processor. By making a purchase, you agree to Stripe's Terms of Service.

**Payment Information**
• We do not store your complete credit card information
• Payment details are handled directly by Stripe in compliance with PCI-DSS standards
• You are responsible for any fees charged by your financial institution

**Billing**
• Credit purchases are one-time payments
• No recurring subscriptions or automatic renewals
• Invoices are available through your account dashboard

**Failed Payments**
• If payment fails, credits will not be added to your account
• You will receive notification of payment failure
• No charges will be made for failed transactions

**Nature of AI Outputs**
PartyPilotAI uses artificial intelligence (OpenAI GPT-4o-mini via Replicate, Kie.ai) to generate party designs. You acknowledge and agree that:

• AI-generated outputs may contain errors, inaccuracies, or imperfections
• Designs are suggestions and may not be suitable for your specific needs or space
• Spatial measurements generated by AI are estimates and should be verified
• AI cannot account for all real-world constraints (load-bearing walls, electrical limitations, local regulations)

**No Professional Advice**
• The Service does not provide professional event planning, interior design, or architectural advice
• You are solely responsible for verifying the safety, feasibility, and legality of implementing any designs
• We recommend consulting with professionals (contractors, electricians, event planners) before implementing complex setups

**Liability Disclaimer**
• We are not liable for any damages, injuries, or losses resulting from implementation of AI-generated designs
• You assume all risks associated with executing party plans
• Always ensure compliance with local building codes, fire safety regulations, and venue rules

**Platform Ownership**
All platform code, algorithms, user interface designs, branding, and proprietary technology ("Platform IP") are owned exclusively by PartyPilotAI and protected by copyright, trademark, and trade secret laws.

**User-Generated Content Ownership**
You own all rights to AI-generated designs created through PartyPilotAI, including:
• Party visualization images
• Floor plans
• Shopping lists
• Any derivative works you create

**License to Use**
By using the Service, you receive a perpetual, worldwide, royalty-free license to use your generated designs for both personal and commercial purposes without attribution.

**User-Uploaded Content**
When you upload photos of your venue:
• You retain all ownership rights to your uploaded photos
• You grant us a limited license to process your photos solely for the purpose of generating your party designs
• We will not use your photos for marketing, algorithm training, or any purpose beyond your specific design generation without explicit consent
• You can request deletion of your uploaded photos at any time

**Restrictions**
You may NOT:
• Reverse-engineer, decompile, or extract the source code of our platform
• Copy, reproduce, or resell our proprietary algorithms or technology
• Use our branding, logo, or trademarks without written permission
• Create derivative works based on our Platform IP

You agree NOT to use PartyPilotAI to:

**Content Restrictions**
• Generate designs for illegal activities or purposes
• Create violent, hateful, or discriminatory content
• Violate any person's privacy or intellectual property rights
• Upload photos containing nudity, violence, or offensive imagery

**Technical Abuse**
• Use automated tools, bots, or scripts to access the Service
• Attempt to gain unauthorized access to our systems or other users' accounts
• Interfere with or disrupt the Service's operation
• Reverse-engineer our AI models or algorithms
• Scrape or extract data from the platform without permission

**Account Abuse**
• Share your account credentials with others
• Create multiple accounts to abuse free credits
• Resell or transfer credits to other users
• Use the Service for commercial resale without authorization

**Consequences**
Violation of this policy may result in:
• Immediate account suspension or termination
• Forfeiture of all unused credits without refund
• Legal action if warranted

**Amazon Affiliate Links**
PartyPilotAI provides shopping lists with direct links to Amazon products. Important disclosures:

• We participate in the Amazon Associates Program and may earn commissions from qualifying purchases
• Prices on Amazon may change without notice
• We do not control product availability, shipping costs, or Amazon's policies
• Product recommendations are generated by AI and may not be perfect matches for visualized items

**No Purchase Guarantees**
• We do not guarantee that linked products are available or in stock
• We are not responsible for product quality, defects, or delivery issues
• Returns and refunds for purchased items are handled directly by Amazon or the merchant

**Price Estimates**
• Price ranges in shopping lists are estimates based on historical data
• Actual prices may vary
• You are responsible for verifying prices before purchase

Your use of PartyPilotAI is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data.

• Payment data is handled securely by Stripe
• Uploaded venue photos are processed solely for design generation
• We use Google Analytics (GA4) for usage analytics

**Your Right to Terminate**
You may delete your account at any time through your account settings. Upon deletion:
• Unused credits will be forfeited
• Generated designs may be retained for 30 days, then permanently deleted
• Personal data will be deleted in accordance with our Privacy Policy

**Our Right to Terminate**
We reserve the right to suspend or terminate your account if:
• You violate these Terms
• You engage in fraudulent or illegal activity
• Your account remains inactive for more than 12 months
• We discontinue the Service (with reasonable notice)

**Effect of Termination**
Upon termination:
• Your license to use the Service immediately ends
• All unused credits are forfeited without refund
• You must cease all use of Platform IP
• Sections of these Terms that should survive (e.g., Indemnification, Disclaimers) remain in effect

**"AS IS" Service**
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
• Warranties of merchantability or fitness for a particular purpose
• Accuracy, reliability, or completeness of AI-generated designs
• Uninterrupted, secure, or error-free service
• Results obtained from using the Service

**Limitation of Liability**
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
• PartyPilotAI shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim
• This limitation applies even if we were advised of the possibility of such damages

**Excluded Damages**
We are not liable for:
• Property damage or personal injury from implementing AI-generated designs
• Lost profits, data, or business opportunities
• Third-party product quality or delivery issues
• Service interruptions or data loss
• Damages from unauthorized account access

**Basis of the Bargain**
You acknowledge that these limitations are a fundamental part of the agreement and reflect the allocation of risk between the parties.

You agree to indemnify, defend, and hold harmless PartyPilotAI, its operator Jacob, and any affiliates from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any third-party rights (copyright, privacy, property rights)
• Implementation of AI-generated party designs
• Any content you upload to the Service
• Your violation of applicable laws or regulations

This indemnification obligation survives termination of your account and these Terms.

**Governing Law**
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where the operator Jacob resides, without regard to conflict of law principles.

**Dispute Resolution**
In the event of any dispute arising from these Terms or your use of the Service:

2. If informal resolution fails, disputes shall be resolved through binding arbitration or small claims court
3. You waive the right to participate in class action lawsuits

**Jurisdiction**
For any disputes that proceed to court, both parties consent to the exclusive jurisdiction of courts in the operator's jurisdiction.

We may update these Terms periodically to reflect changes in:

• Legal or regulatory requirements
• Business practices

**Notification**

• Changes become effective 30 days after notification
• Continued use of the Service after changes constitutes acceptance

**Right to Object**

**Entire Agreement**
These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and PartyPilotAI.

**Severability**
If any provision is found unenforceable, the remaining provisions remain in full effect.

Our failure to enforce any right or provision does not constitute a waiver of that right.

**Assignment**
You may not assign these Terms without our consent. We may assign these Terms without restriction.

**Force Majeure**
We are not liable for delays or failures caused by circumstances beyond our reasonable control (natural disasters, wars, internet outages, etc.).

**Language**
These Terms are provided in English. Any translations are for convenience only. In case of conflict, the English version prevails.
